Announcement:  Lower Merion Township has adopted a Single Use Plastic Carry-Out Bag Ordinance.

On May 3, 2023, the Board of Commissioners Sustainability Committee voted unanimously to advertise the Draft ordinance for Single Use Plastic Carry-Out Bags. On May 17, 2023, the Board of Commissioners authorized the advertisement. On June 21, 2023, the Board of Commissioners voted unanimously to adopt the ordinance. On September 27, 2023, the Board of Commissioners authorized an amendment to the code that retail establishments shall charge not less than $0.10 per compliant bags. Ordinance enforcement began on January 21, 2024. Customers are encouraged to BYOB - Bring Your Own Bag, Lower Merion!

The ordinance bans single use plastic carry-out bags from retail establishments, and requires retailers to charge a fee of at least $0.10 for compliant paper and reusable bags.

The ordinance allows retailers to provide consumers with recyclable paper bags or reusable bags at the point of sale, for a charge of at least $0.10 per bag. In the ordinance: 

  • The retail business keeps the bag fee
  • The bag fee must be separately stated on the customer's receipt

The ordinance affects certain retail businesses such as restaurants, clothing stores, convenience stores, drugstores, farmer's markets, grocery stores, and other general merchandise retailers. It does not apply to dry cleaners, food banks, food pantries, senior citizen centers or similar meal centers operated by nonprofit organizations or religious institutions. 

Single use plastic carry-out bags include plastic bags that are provided by establishments at the point of sale. They do not include product packaging, newspaper bags, dry cleaning bags used to wrap raw food products, or bags sold in packages containing multiple bags, such as garbage bags, lawn bags or pet waste bags. However, retailers and consumers are encouraged to find plastic-free alternatives to exempt bags, too! For example - bring reusable produce bags to the grocery store, buy loose produce instead of pre-packaged items, and ask your dry cleaner if they offer reusable garment bags.
