Description of requirements for this board

Membership: Is composed of 3 members all of which shall be residents of the Township appointed by the Board of Commissioners as provided by law. An officer or employee of the Township may not be a member of the Zoning Hearing Board.

Term of Office: 3 years or until his successor is appointed and qualified.

Meeting Time and Place: The meeting dates vary but are typically held on Thursday evenings each month at 7:15 PM in the Board Room, Township Administration Building.

Department Liaison: Director of Building and Planning & Township Zoning Officer

Duties and Responsibilities:

The zoning hearing board shall have exclusive jurisdiction to hear and render final adjudications in the following matters:

  1. Substantive challenges to the validity of any land use ordinance.
  2. Challenges to the validity of a land use ordinance raising procedural questions or alleged defects in the process of enactment or adoption.
  3. Appeals from the determination of the zoning officer, including, but not limited to, the granting or denial of any permit, or failure to act on the application, the issuance of any cease and desist order or the registration or refusal to register any nonconforming use, structure or lot.
  4. Appeals from a determination by a municipal engineer or the zoning officer with reference to the administration of any flood plain within a land use ordinance.
  5. Applications for variances from the terms of the zoning ordinance.
  6. Applications for special exceptions under the zoning ordinance.

MEETING NOTICE AND HEARING NOTICE
TOWNSHIP OF LOWER MERION
ZONING HEARING BOARD

 

Notice is hereby given that the Zoning Hearing Board of Lower Merion Township will hold a Meeting of the Board as authorized by Section 111 of Chapter 155 of the Lower Merion Code, as amended, to take official Board action. Notice is hereby given that the Zoning Hearing Board of Lower Merion Township will hold a Hearing of the Board as required by Section 113 A of Chapter 155 of the Lower Merion Code, as amended, and Section 908 of the Pennsylvania Municipalities Planning Code.

The Meeting shall be held at the Township Building, 75 East Lancaster Avenue, Ardmore, PA, on Thursday, February 23rd, 2017, at 7:15 PM. The Hearing shall commence immediately following the Meeting and at the same location on the following matters:


Appeal No. 4404                   

Applicants:    Arthur Alzate and Myrna Tan
Property:        617 General Lafayette Road, Merion, PA 19066
                             (Election District #13)  R 2 and R 1 Residence Districts

A portion of the applicants' attached garage is over the southern side property line and infringes on to the adjacent property at 613 General Lafayette Road.  The applicants propose a lot line change and equal lot area exchange with 613 General Lafayette Road and request a dimensional variance from §155-24 D(1) to allow the garage to remain 4 feet from the side property line, within the minimum side yard setback, after approval of the lot line change is obtained.

Applicant:       Lower Merion School District
Property:        Bala Cynwyd Middle School/Cynwyd Elementary School
                              510 Bryn Mawr Avenue, Bala Cynwyd, PA  19004
                              (Election District #13)  R 4 Residence District

 To accommodate increasing student population, the Lower Merion School District (LMSD) proposes in this application the following improvements to the Bala Cynwyd Middle School: 1) construct 6 temporary modular classrooms within the cinder track area to be occupied until 2019, and 2) construct a 12-space parking lot with driveway access to and from Manayunk Road for required parking for the temporary modular classrooms.  Applicant intends, in a subsequent application to the Board of Commissioners, to seek a conditional use approval to hold the 12 parking spaces and driveway in reserve and remain unpaved.  To the extent required, LMSD requests a variance from §155-32F and §155-141.5 to exceed the permitted percentage of impervious surface cover limit.
