Zoning Hearing Board


Notice is hereby given that the Zoning Hearing Board of Lower Merion Township will hold a Meeting of the Board as authorized by Section 111 of Chapter 155 of the Lower Merion Code, as amended, to take official Board action. Notice is hereby given that the Zoning Hearing Board of Lower Merion Township will hold a Hearing of the Board as required by Section 113 A of Chapter 155 of the Lower Merion Code, as amended, and Section 908 of the Pennsylvania Municipalities Planning Code.

The Meeting shall be held at the Township Building, 75 East Lancaster Avenue, Ardmore, PA, on Thursday, July 28, 2016, at 7:15 PM. The Hearing shall commence immediately following the Meeting and at the same location on the following matters:

Appeal No. 4392

Applicant: Al Pereira
Property: 126 Jones Street, Bala Cynwyd, PA 19004
(Election District #3) R 5 Residence District

The applicant proposes to construct an in-line second story addition on top the existing one-story right side portion of the dwelling and requests a variance from §155-36 A(4) to allow the addition to infringe into the required side yard setback. The applicant also requests to the extent required, any other relief or approval necessary to allow the proposed addition.

Applicants: Mark Sheehan and Lorna Weir
Property: 1414 Youngs Ford Road, Gladwyne, PA 19035
(Election District #2) R A Residence District

The applicants propose to construct an in-line left side one-story enclosed porch addition and a right side second-story addition on top of an existing one-story portion of the dwelling, where portions of the additions would infringe into the required 50 ft. front yard setback. The applicants are appealing the determination of the Zoning Officer, pursuant to §155-110, that the proposed additions cannot infringe into the front yard setback by right. The applicants request a determination that the additions can be built within the front yard setback as a matter of right, contending that the additions will not infringe further into the front yard setback than the existing dwelling walls. Alternatively, the applicants seek a variance from §155-16 C to allow the additions to infringe into the required front yard setback, and to the extent required, any other relief necessary to allow the proposed improvements.

Appeal No. 4388

Applicants: Steven Wieland and Susan Barr
Property: 508 Sussex Road, Wynnewood, PA 19096
(Election District #8) R 3 Residence District

This is a continuation of a hearing held June 23, 2016. The applicants propose to demolish the single-family detached dwelling and related improvements, mostly within the FEMA Floodplain District, relocate and construct a new dwelling, all within the Lower Merion Floodplain District. The applicants are appealing the determination of the Zoning Officer that the proposed relocation and construction within the floodplain is not allowed as a matter of right and requires a variance. The applicants contend that the reconstruction is permitted by right, that it is a continuation of a legal nonconforming use, and request approval pursuant to §155-99 A to construct the new dwelling and related improvements. The applicants also seek the following:

  1. a special exception under §155-160 B for minor grading associated with the removal, relocation, and reconstruction of the dwelling,
  2. a special exception for driveway paving,
  3. a variance, if determined to be necessary, from §155-161 to construct the relocated dwelling within the Lower Merion Floodplain, and
  4. to the extent necessary, a variance from §155-114 D(2) to not install a buffer.

Applicants: Footbridge, L.P. and Bridgehead, L.P. both c/o Penn Real Estate Group, Ltd.
Property: 601/609 Righters Ferry Road and 615/620 Righters Ferry Road
Bala Cynwyd, PA 19004
(Election District #9) M Manufacturing and Industrial Districts

The applicants propose to consolidate the properties, demolish the existing warehouse/manufacturing buildings between the Penn Real Estate Group office and the AFC Fitness Center, and develop two hotel buildings. The applicants seek a special exception pursuant to §155-160, and specifically §155-160 D, to construct the hotel buildings and associated improvements, all within the floodway fringe of the Schuylkill River. To the extent required, the applicants request any other relief or approval necessary to allow the proposed development.
