Preliminary Agenda

    Minutes from Special Meetings of the Board dated June 11, 2008 and the stated meeting of the Board of Commissioners dated June 18, 2008 as distributed.

  4. Announcements

    Report Out – that the Board met earlier this evening to receive reports from its professional staff.

    Report Out – that certain actions were taken at special Board of Commissioners meeting held Wednesday, July 9, 2008 which resulted in the scheduling of the following public hearing to be held on Wednesday, September 10, 2008 on an ordinance amendment to amend the Code of the Township of Lower Merion, Chapter A180, Zoning, Historic Resource Inventory, to add/remove certain properties to/from the Historic Resource Inventory. 

  5. Public Hearings

    1. An ordinance amendment to amend the Code of the Township of Lower Merion, Chapter 155, Zoning, to provide that an accessory apartment as an incentive use for Class I and Class II resources in the Historic Resource Overlay District, can be the only other single family dwelling unit on a property and must have two off-street parking spaces.

    2. An ordinance amendment to amend the Code of the Township of Lower Merion, Chapter 155, Zoning, to amend the Code of the Township of Lower Merion, Chapter 133, Streets and Sidewalks, to define a “Temporary Sign” and to increase the period of time a temporary sign may remain in the public right of way; to permit temporary signs within a public right of way to be placed within twelve inches of the curbline; and to amend Chapter 155, Zoning, Article XIX, Signs, to define a “Temporary Sign” and “Personal Interest Sign”; to remove the definitions of “Artisan Sign” and “Political Sign”; to remove time restrictions with respect to the display of certain temporary signs; to exempt certain temporary signs from requiring a permit fee where they remain erected for a period of less than forty-five days and are less than six square feet in area; and to allow temporary signs in residence districts.

  7. The Floor is now open to provide the opportunity for the public to address the Board on matters relating to agenda items, which will be voted upon at this meeting.

    Response to Public Comment - Appropriate time for any member of the Board, the Township Manager, or designated staff person to address or respond to any statement made by a member of the public during the Public Comment portion of the agenda.

  8. Public Privilege of the Floor

  9. The Floor is now re-opened to provide the opportunity for the public to address the Board on any non-agenda item or any other public matter in which the Township has jurisdiction or authority.

    Response to Public Privilege of the Floor - Appropriate time for any member of the Board, the Township Manager, or designated staff person to address or respond to any statement made by a member of the public during the Public Privilege of the Floor.

  11. The Consent Calendar items are indicated with a "(Consent)" notation in the immediate left-hand column next to each Committee item on the regular monthly Board agenda. If there were no request from any member of the Board for separate discussion of any item listed on the consent calendar, in which event the item would be removed from the Consent Calendar and considered in its normal sequence on the agenda.

    AN ORDINANCE To Amend The Code Of The Township Of Lower Merion, Chapter 7, Board Of Commissioners Procedural Code, To Provide That Those Persons Appointed By The Board Of Commissioners To Township Committees, Boards And Commissions Shall Serve For Their Designated Term And Until Their Successors Are Duly Appointed And Qualified; And To Provide A Procedure For The Removal From Office Of Appointed Members Of Committees, Boards Or Commissions For Malfeasance, Misfeasance, Nonfeasance Or Other Just Cause And To Provide For The Appointment Of A Successor To Fill The Unexpired Term.

    This Ordinance was authorized for advertising at the July 2, 2008 meeting of the Board of Commissioners and duly advertised in the July 9, 2008 issue of Main Line Life.

  5. CONSIDER FOR DENIAL a Certificate of Appropriateness for 8 E. Lancaster Avenue, Ardmore, Ardmore Marble and Granite Inc. to modify the awning sign fabric color and copy, previously approved by the HARB.
  6. On July 1, 2008, HARB recommended denial noting that the proposed design appears to be too much signage area to meet that which is allowable under the Zoning Code. HARB recommended a committee work with the applicant to design a more appropriate awning to present to the full Board for their review.

These items were referred to the Board at a meeting of the Building & Planning Committee held July 9, 2008.

AN ORDINANCE To Amend The Code Of The Township Of Lower Merion, Chapter 32, Pensions And Employee Benefits, To Provide For The Continuation Of The Police Pension Fund Of The Township Of Lower Merion Originally Effective As Of February 20, 1957, As Amended From Time To Time; To Provide That The Plan Describing The Fund Shall Be Maintained In The Office Of The Township Manager And Shall Be Available For Inspection; To Provide That The Fund Shall Be Managed And Administered By A Five Person Board Of Trustees; To Provide For The Appointment Of The Board Of Trustees; To Provide For The Appointment Of The Township Manager As The Plan Administrator; And To Provide That The Plan Administrator Shall Keep The Minutes Of The Board Of Trustees.

    This Ordinance was authorized for advertising at the July 2, 2008 meeting of the Board of Commissioners and duly advertised in the July 9, 2008 issue of Main Line Life.

AN ORDINANCE To Amend The Code Of The Township Of Lower Merion, Chapter 111, Peace And Good Order, Article VII, Graffiti, Shall Be Amended To Provide A Statement Of Purpose For The Regulation Of The Sale Of Spray Paint And Indelible Markers; Requiring The Posting Of Signs On Spray Paint And Indelible Marker Displays; Requiring The Posting Of Signs That It Is A Violation Of Law To Sell Spray Paint And Indelible Markers To Minors; And Requiring The Prompt Removal Of Graffiti By Property Owners.

    This Ordinance was authorized for advertising at the July 2, 2008 meeting of the Board of Commissioners and duly advertised in the July 9, 2008 issue of Main Line Life.

  5. PRESENT FOR ADOPTION ORDINANCE NO. ___________.

  6. AN ORDINANCE To Amend The Code Of The Township Of Lower Merion, Chapter 145, Vehicles And Traffic, To Provide That Violations Of Those Provisions Of The Township Ordinances Code Imposing Parking, Standing And Stopping Restrictions May Be Enforced By The Director Of Parking Services As Well As By Police Officers And Meter Attendants.

    This Ordinance was authorized for advertising at the July 2, 2008 meeting of the Board of Commissioners and duly advertised in the July 9, 2008 issue of Main Line Life.

  7. CONSIDER FOR APPROVAL a resolution authorizing adoption of the Police Pension Fund Plan Document effective August 1, 2008.
